Abrarul Haq says he is still taking legal action against Karan Johar, T-Series over 'Nach Punjaban'

The singer said that he hasn't given anyone the right to use his song and it still belongs to him.

Giving someone a line of credit in a YouTube video isn't enough to make up for taking their work. Abrarul Haq definitely feels this way, especially if it involves his song. The singer posted a video targeting Indian filmmaker Karan Johar and T-Series for "crediting" him after much controversy over film Jugjugg Jeeyo's official trailer that features Haq's song 'Nach Punjaban'.

On Saturday, the singer took to Twitter and shared a video clip of himself saying that he is adamant about taking legal action against the filmmaker for using his song. On May 28, Johar shared the first official song titled 'The Punjaabban Song' where the JugJugg Jeeyo cast, Varun Dhawan, Anil Kapoor, Kiara Advani and Neetu Singh, can be seen dancing to the popular chorus and hook of Haq's song from his 2002 album Nach Punjaban.

The video contained credits to the singers and lyricist behind the song and included Haq's name after Tanishk Bagchi. But that's not enough for Haq.

"A lot of fans have been asking me 'why haven't you gone to the court against Karan Johar and T-Series for stealing your song 'Nach Punjaban'. The answer is yes I'm going to the court don't worry. Merely saying that the credit has been given because the song is well written and would make their movie a hit. I never gave you the song, I never gave anybody the rights to my song. It belongs to me so I'll get it back and I'm coming to the court, see you there," he said in the video.

In his tweet he also tagged the record label T-Series and Moviebox who have not yet responded on Twitter. Both previously claimed the rights to Haq's song and issued statements in response to Haq's plagiarism claim.

On May 22, the 'Billo' singer had tweeted, "I have not sold my song 'Nach Punjaban' to any Indian movie and reserve the rights to go to court to claim damages. Producers like Karan Johar should not use copy songs. This is my 6th song being copied which will not be allowed at all."

In response to his claims record label Movie Box said on Twitter that the song had been officially licensed to be included in the film and that Johar and his production company have the legal rights to use the song in the upcoming movie. They also called the 53-year-old singer's tweet "defamatory" and "completely unacceptable".

Later Haq clarified in an additional tweet that his song hasn't been "licensed" to anyone either and if anyone tries to claim it, they must produce an agreement to back up their claims. In the tweet, Haq repeated his threat of taking legal action against the Johar and the production label.

'The Punjaabban Song' uses same tune and guitar hook of the 2002 original 'Nach Punjaban' as well as its chorus. However, some of the lyrics are different than Haq's song.

JugJugg Jeeyo is directed by Raj Mehta and is a joint production between Johar's Dharma Productions and Viacom18 Studios. Starring the crème de la crème of the Bollywood industry, the film is set to release in Indian cinemas on June 24 this year.

He sold his song to a music label moviebox decades ago and they are selling it on iTunes and their YouTube channel.What is he doing from 20 yrs if they are using without his permission? This song is well written, well sung, well composed and well directed in film, but Karan Johar should not copied it in his film until he gets okayed by singer Abrar ul Haq and cleared all copied rights legal issues. Its never too late just talk to him and make a deal and be friendly.

Abrarul Haq needs to get a little knowledge about the Laws Governing Music Industry before he starts shouting around. 1. Rights to a Song belong to the Lyricists - not the Singer. 2. Rights to the Tune belong to the Music Director - not the Singer. Noor Jahan, Lata and Rafi are not getting any money for all the songs they sang. A Singer only provides a Service for Money to the producer of the song. 3. Any award for a Landmark Building goes to the Archtect who Designed that building, not to the Contractors and the labourers. Lastly, when was the last time Pakistan Government/Citizen won any major Law Suit in any International Court. All A Haq wants is Publicity that may increase the sale of his next album.

In which court is he going to Sue. There is no sense in suing in India Pakistan. Abrar has jumped the gun he should have let the movie release and do great business. Then he should have sued their pants off in the United States or uk. There the courts are very strict about copying and cheating and lying. Just today Mariah Carey copied a song of another singer and made 60 million dollars she is being sold for 20 million dollars. In US there have been many cases of piracy that have been successfully sued and the cheaters have to pay heavy and fine.. I assure you he will get a lawyer here to go after them and he doesn't have to spend a money which is all contingency. Protection of an individual's intellectual property is a very serious business for the court. By the way the Indian music today is garbage no music no lyrics no singing do not understand even the words that is being sung. I will suggest that in US he can Sue not only the producer but also the distributor.

Don't get mad.... get practical. Sue them all in an American court which will put punitive damages on them and Indian industry is tied with Netflix and Hollywood, and the judgement would be huge, they cant afford it, and we Americans hate dishonesty & copyright infringement. Bring them all to justice, file your case in the USA. Plenti of copyright attorneys who will work pro-bono.

I checked both Spotify and Apple Music for the credit section, and the copyrights of the song belong to Moviebox (Birmingham) Limited. T-Series have purchased the rights from them as per the credits section of the new song which says "Courtesy of Moviebox (Birmingham) Limited".

Lots of negative comments about India, Indians and Hindus.. Karan Johan could be wrong here but that does not mean entire India, Indians, Hindus are wrong.. Why generalise for something done by one person which may be incorrect? Furthermore, I hope the ppl who are making negative comments checked who owns the copyright. Normally it is owned by Music Producer and not the singer. Singer gets money from producer for singing. So singers may not be entitled to claim right and producer has full right to sell to anyone they like.

@T-man - Haq is No Longer the Owner of the song because he sold the rights to 'Moviebox Records'. T-Series had Legally Acquired the Rights to adapt the song from Moviebox Records; and they had given credit to the Lyricist. If Haq wants to sue anyone he needs to Sue Moviebox Records.

In US music recorded saying and sold in the market are all in the public view.. They don't have to register it or patent. All they have to prove in the court that it was already there and it belongs to this person and there is evidence for that.
